Scratch Card Promotion
- Official Competition Rules
1.
Promotion Period
The
"CADSTAR Scratch Card Competition" ("the Competition")
begins July 9th, 2001 and ends November 23rd, 2001 at 12.00p.m.
Greenwich Mean Time ("GMT"). Drawings will take place
weekly. To be eligible for the final drawing, entries must be received
by 12.00p.m GMT on Friday November 30, 2001. This promotion is sponsored
by Zuken Limited of 1500 Aztec West, Almondsbury, Bristol, BS32
4RF, UK ("Zuken").
2.
Eligibility
The
Entrant must have Internet access. Employees, contractors, or re-sellers
of Zuken, including the administrators of the drawing, the immediate
families of such employees or contractors and the administrators
of the drawing, together with those whom such persons are domiciled,
and government employees associated with procurement, unless otherwise
authorised under the laws of jurisdiction concerned, are not eligible.
3.
To Enter
Entrants
must correctly answer three randomly chosen questions about CADSTAR
(the "Preliminary Questions"). Failure to correctly answer
the Preliminary Questions will result in rejection of entry. Entrants
may, upon rejection of entry, make further entry. Upon successfully
answering the Preliminary Questions, Entrants must complete the
registration form found at the end of the questions. ("the
Registration Form"). Only one Registration Form will be accepted
per person and e-mail address during the period of the Competition.
Failure to provide all of the information requested in the Registration
Form may result in delay or rejection of entry. All eligible Registration
Forms received during the previous week will be entered into a draw
to take place on the Friday at 12.00p.m. GMT. The draw will be administered
by Zuken.
4.
Prize
One
HP Jornada 545 pocket PC will be awarded each week for 25 weeks
to the first eligible Entrant drawn from all Registration Forms
submitted during the previous week. The chances of winning a prize
are dependent on the number of eligible Registration Forms received.
Winners may waive the right to receive the prize. No cash or other
substitution is allowed, except by Zuken, which reserves the right
to substitute a prize of comparable or greater value if a specified
prize can not be awarded, as described, for any reason. Prizes must
be accepted as awarded and are non-assignable and non-transferable.
Allow for 4-6 weeks for delivery. LIMIT: ONE ENTRY PER PERSON OR
E-MAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES
THE SAME E-MAIL ADDRESS). E-MAIL CHANGE OF ADDRESS POLICY: IT IS
THE SOLE RESPONSIBILITY OF THE ENTRANT TO NOTIFY ZUKEN IN WRITING
IF THE ENTRANT CHANGES HIS/HER E-MAIL ADDRESS.
5.
Terms and Conditions
PARTICIPATION
IN THE COMPETITION CONSTITUTES ENTRANT'S FULL AND UNCONDITIONAL
AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES AND ENTRANT
HEREBY RELEASES ZUKEN, ITS SUBSIDIARIES, DIVISIONS, AFFILIATES,
OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY
ARISING OUT OF ENTRANT'S PARTICIPATION IN THE COMPETITION AND ENTRANT'S
RECEIPT AND USE OF ANY PRIZE (EXCEPT NEGLIGENCE OF ZUKEN RESULTING
IN DEATH OR PERSONAL INJURY). ZUKEN IS NOT RESPONSIBLE FOR LOST,
LATE, INCOMPLETE, ILLEGIBLE OR MISDIRECTED E-MAIL, FOR FAILED, PARTIAL
OR GARBLED COMPUTER TRANSMISSIONS, OR FOR TECHNICAL FAILURES OF
ANY KIND, INCLUDING, BUT NOT LIMITED TO, ELECTRONIC MALFUNCTION
OF ANY FACSIMILE EQUIPMENT, NETWORK, HARDWARE OR SOFTWARE. THE REGISTRATION
FORMS BECOME THE PROPERTY OF ZUKEN AND NONE WILL BE RETURNED. Zuken
reserves the right to cancel or modify the Competition if fraud,
technical failure or any other factor beyond Zuken's reasonable
control that impairs the integrity of the promotion arises, as determined
by Zuken in its sole discretion. As a condition of entering the
Competition, the Entrant agrees that all decisions of Zuken are
final and conclusive in all matters relating to the administration
of the Competition and the determination of winners. The Entrant
further agrees that:
(i)
any and all disputes, claims and causes of action arising out of
or connection with this Competition or any prizes awarded, other
than the administration of the Competition or the determination
of winners, shall be resolved individually, without resort to any
form of class action;
(ii)
any and all claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering
this Competition, but in no event legal fees; and
(iii)
under no circumstances will the Entrant be permitted to obtain awards
for and the entrant hereby waives all rights to claim punitive,
incidental and consequential damages and any other damages other
than for actual out-of-pocket expenses and any and all rights to
have damages multiplied or otherwise increased.
6.
Law and Jurisdiction
These
Terms are governed by the laws of England and Wales and the Entrant
agrees that the Courts of England are to have exclusive jurisdiction
in relation to any claim against Zuken arising out of a dispute
relating to these Rules.
7.
Personal Data
Zuken
may use any or all data regarding entrants obtained from the Registration
Form for administration of and publicity in connection with the
Competition and for market research, future promotions and information
regarding products and services of Zuken and its associated companies.
The Entrant agrees to such use of the personal data, which will
be kept at Zuken's premises in Bristol, UK.
8.
Winner Notification
Winners
will be notified by telephone and/or e-mail during the week following
the drawing.
9.
Acceptance of Terms
Entry
into this Competition by the Entrant, including but not limited
to attempts to answer the Preliminary Questions and/or submission
of the Registration Form, will be deemed as acceptance by the Entrant
of these Rules.
